Bulgarian Father Remains in Custody as Legal Gap Delays Bail in Xylofagou Tragedy

In Xylofagou a Bulgarian father of two boys was found dead in a parked car on June 28. His eight‑year‑old and ten‑year‑old sons were discovered lifeless inside the vehicle. The father now faces two counts of causing death by a rash, reckless or negligent act and has been in custody since his arrest. His bail application was rejected on Monday by senior British bases judge.

Bail appeal was denied because of a legal gap between Sovereign Base Areas and Republic of Cyprus. Lawyer Christos Th. Theodoulou said the decision was not about father’s conduct but because British‑base arrest warrants cannot be enforced on Republic territory. Defence noted the Bases can return people to the Republic but Cyprus lacks reciprocal legislation. Evidence showed more than 1,300 arrest warrants remain outstanding, hampering bail for anyone facing SBA courts. Lawyers are now considering legal action against Republic.

The father has been in custody since his arrest, and previous bail applications were rejected over concerns he might abscond and because SBA authorities cannot enforce bail conditions outside their jurisdiction. His lawyers highlighted his long residence in Cyprus and his cooperation with investigators. Case will continue with trial set for November 30.

For CarCY readers tragedy underscores vital need for vehicle safety, especially when children are present. Drivers should never leave passengers unattended in a car, as even brief moments can become fatal. Legal complexities surrounding bases also remind road users that incidents near SBA can involve multiple jurisdictions, making prompt cooperation with authorities essential.
